THE TYPICAL DIVORCE
PROCESS IN Australia
Submission Request
A party initiates the process by submitting a request through their chosen provider. The other parties are contacted to assess interest in mediation and discuss the issues that they would like to address throughout the process.
Explanation & Agreement
Staff will then explain the process to all parties involved to elicit agreement to participate. Once an agreement is met, the process can begin
Mediator Selection
Once the process has officially begun, parties are required to select a mediator from a list we’ll provide. If there is a preferred mediator not on the list that is desired, a special request can be made.
Signature Of Agreement
Once a mediator is selected, a ‘mediation submission agreement’ is signed by all parties and submitted.
Pre-Session
Prior to the first mediation session, the chosen mediator will process all relevant documents and information related to the case.
Initial Session
The initial session will typically take place with all parties present where the mediator will breakdown the foreseeable process and responsibilities for all parties. Each party will then present their issues to both the mediator and the opposing party.
Follow-Ups
Depending on the case, there may be multiple mediation sessions needed. Sometimes disputes can be solved through a singular session, if this is not the case then there is expectation of multiple sessions to ensure an agreement is made.
Facilitating Offers & Options
Mediators may choose to have sessions with one party at a time to discuss options and present offers and options that will be updated as the case progresses.
Settlement
Optimally, a mediation will end with a settlement agreement. If both sides agree and sign an official form, then it becomes enforceable.
Contingencies
If a resolution is not found then alternatives will be considered from arbitration to courtroom trials – there is also the option of revisiting mediation at a later date.

CHILD CUSTODY MEDIATION

WILL DISPUTE MEDIATION
When a loved one passes on, the last thing anyone wants to deal with is disputes and disagreements regarding their last will and testament. Unfortunately, will disputes can occur between conflicting parties which can lead to long-lasting litigious battles.
POST-SEPARATION MEDIATION
We have several specialty services at Family Mediation Online, perhaps the most foundational being post-separation mediation and negotiation for separating parties. Post-separation mediation is an excellent method of dispute resolution that doesn’t involve courtrooms or long-lasting headaches.
FINANCIAL SETTLEMENT SERVICES
After a separation, the inevitable and often emotionally-taxing process of asset division between the separating parties needs to take place. Post-separation negotiations and discussions are often laden with emotion and become quarrelsome rather quickly which can lead to costly and elongated court battles that tend to exacerbate issues and prolong distress.
PARENTING MATTERS
Following a relationship breakdown, one source of emotionally compromising circumstances stems from the prospects of future care for any children that are involved in the relationship. Dealing with a dissolving relationship is tough enough, factoring in the balances and various facets of a child’s life in conjunction with that can become taxing to all parties very quickly.
