Staff will then explain the process to all parties involved to elicit agreement to participate. Once an agreement is met, the process can begin

Mediator Selection

Once the process has officially begun, parties are required to select a mediator from a list we’ll provide. If there is a preferred mediator not on the list that is desired, a special request can be made.

Signature Of Agreement

Once a mediator is selected, a ‘mediation submission agreement’ is signed by all parties and submitted.

Pre-Session

Prior to the first mediation session, the chosen mediator will process all relevant documents and information related to the case.

Initial Session

The initial session will typically take place with all parties present where the mediator will breakdown the foreseeable process and responsibilities for all parties. Each party will then present their issues to both the mediator and the opposing party.

Follow-Ups

Depending on the case, there may be multiple mediation sessions needed. Sometimes disputes can be solved through a singular session, if this is not the case then there is expectation of multiple sessions to ensure an agreement is made.

Settlement

Optimally, a mediation will end with a settlement agreement. If both sides agree and sign an official form, then it becomes enforceable.
